PARIS (AFP) - – A French court on Friday ordered online auction site eBay to pay 80,000 euros (118,000 dollars) to Louis Vuitton for selling fake luxury perfumes, LVMH said.
"The court found that in using key words from certain LVMH brands, eBay had commited several acts of counterfeiting," LVMH said in a statement.
It cited among the perfume marques top range Parfums Christian Dior, Kenzo, Givenchy and Guerlain.
The court ordered eBay to pay 80,000 euros to LVMH as compensation and order that it would have to pay 1,000 euros for any subsequent infraction.
In June last year, the Paris commercial court ordered eBay to pay nearly 40 million euros in damages to Louis Vuitton for selling fake luxury goods in a ruling that was cheered as a victory for copyright protection.
The commercial court had ruled in favour of six LVMH brands and also barred eBay from selling four perfumes -- Christian Dior, Kenzo, Givenchy and Guerlain -- on its websites.
**SO LET THIS NEWS SERVE AS A LESSON. THOUGH EBAY IS TELLING US THAT THEY GUARANTEE EBAYERS WITH PROTECTION FROM FRAUD, WE CANNOT HELP BUT THINK IF THEY MIGHT BE CONNIVING WITH THESE FRAUD SELLERS BECAUSE APPARENTLY, THEY HAVE BEEN FINED AGAIN. SO IF YOU'RE PLANNING TO PURCHASE MAC COSMETICS, LOUIS VUITTON, BALENCIAGA OR ANY HIGH- END BRAND, PLEASE, SAVE YOURSELF FROM ALL THE HASSLE BY BUYING FROM OFFICIAL STORES AND RETAILERS.

I honestly think they are not conniving with these fraudsters. They do have a Fraud department (which I was once part of) but there are just too much scammers and fraudsters around the world. I am not saying they aren't doing anything but I also can't help but wonder if they are ever really doing something about reports of fake stuff at all. Well, maybe they are but it's just not enough. I get frustrated as well but to think of then conniving with these cons would be unfair, IMO. They should be stricter and be more pro-active. They thought they can just get away with "we are just an online auction site" but here's proof that they can't. By now, I think they should have learned their lesson, but I don't think they did. No wonder someone was right in saying that eBay has lost some of its magic".
ReplyDeleteA lot of people are doing their best to spot fraudsters and scammers even though they are not paid to do it. Some eBayers took it upon themselves to warn their fellow eBayers off these scumbags. There is a thread called SCAM Patrol on the eBay ph boards.
Just my 2 cents. :)
i've bought some stuff off ebay before, like makeup that's hard to get here or quite expensive. it is much cheaper sometimes when you buy it off ebay, but please please please check the seller's feedback, do your own research, find out what the product looks like, smells like, should be like, before you bid.
ReplyDeletethat's the best way you can protect yourself. =)
here here girls.
ReplyDeletewell, these scammers have a way with everything. and for the mos unfortunate part, they can get away with everything!
the way this post seemed to me, maybe ebay is trying their best prevent these fake stuff in their sites but the fact that they have been fined twice, there should be something lacking with their security and they also lack research. I think that they should have bargained with the european government that every newly uploaded high- end bag should be checked by official connoisseurs from LV, Givenchy, Chanel, Guerlain, etc. that I think that they should hire for them to prevent from losing millions of cash.
it's a hectic job but there's no other way to do it instead of losing millions. i also think that they should implement rules regarding selling of high- end bags. they should take a picture of the serial numbers, close- ups of the items and most especially, official receipts. if the seller can't present any official receipts, then they shouldn't be allowed to advertise their item, even if they say that they are trusted in ebay and that their items are authentic. of course, we can't trust anyone anymore so these measures will save ebay from bankruptcy and from being closed down.
about the conniving thingy, it might be 2% of the whole story, and it may be a far cry from being true but hey, anything can happen. like what i said, they have been find for 2 million euros before, then with that great loss, why didn't they tighten their security up? :D
just a crazy thought. :D
Let me know what you think of this post! :)
